eAllocation
IDRC's eADR Software has within its database complete details of the empaneled Arbitrators, Mediators and Conciliators. These details include their Educational accomplishments, Degrees, speclisiations, experience and domain expertise.
The software allowes the Claimant to identify the nature of the dispute raised in the claim petition or Mediation/Conciliation application and once this input is made available, the softare sifts through the panel of ADR professionals and suggests the names of the ADR professional most suited for the dispute.
This methodology shall be adopted only if the parties do not agree to a particular ADR professional's name.
The World Bank's 'Doing Business Report' also promotes random allocation of Commercial Disputes amongst the available Special Commercial Courts whic in our case shall be a panel of domain experts vis a vis a particular dispute.
In view of this the Task Force on Ease of Doing Business under Department of Justice, Ministry of Law and Justice, Govt of India has also recommended inclusion of random allocation of cases in Commercial Courts in the Case Information System Software prepared by NIC.
The European Network of Councils for the Judiciary, ENCJ, in its Minimum Judicial Standards on allocation of Cases Report has also recommended random allocation of cases but also advocated that exemption from this may be made for cases or matters of particular kind which needs specialisation.
