eNotices

IDRC's eADR has a functionality for issuance of eNotices. The portal has an end to end paperless environment which rules out need of issuance of paper hardcopy Notices. 

The Software has provision for entering the postal details of all the respondents as well as claimant and co-claimants in the cloud servers. Once the same is done the requsite eNoticies can be issued by click of mouse via emails.

The CPC (Amendment) Act, 1999 (46 of 1999) which came into effect from July 01, 2002 had brought some of the changes into the Civil Procedure Code, 1908 like summons through courier, Fax and e-Mail. These changes facilitate the use of electronic media into the legal system. Order 5, Rule 21 and 24 CPC are amended to include the ‘Fax and Electronic Mail Services’ as modes of serving summons to defendants residing within the jurisdictions of another court to the defendants residing in the prisons, Rule 14 of Order 18 is amended to facilitate the recording of media. The amendments to CPC are made with an intention to avert delays in the justice delivery mechanism. The Supreme Court of India has upheld the constitutional validity of the amendments to Civil Procedure Code (CPC) and allowed recording of evidence through audio and video techniques.

The Evidence Act, 1872 is also amended to include the ‘electronic records’ as admissible evidence. Section 4 of Information technology Act, 2000 provides for legal recognition of electronic records and electronic contracts.

The ITA-2000 was a big step towards introducing Cyber Laws for India. First of all, it provides a legal recognition for Electronic Documents and Digital Signatures as equivalent to the “Written” or “Typed” or “Printed” counterparts.
